The "Tertiary Decree":
a (hoped-for) postponement for taxpayers!
Small reminder:
The tertiary decree is an obligation to reduce energy consumption applying to all buildings with a floor area of tertiary premises exceeding 1,000 m² as well as to mixed-use buildings (e.g., tertiary + housing) whose total surface area of tertiary activities is ≥ 1,000 m2. Only places of worship, temporary constructions and buildings ensuring an activity of defense, internal security and civil security are exempted.
In case of non-compliance with the regulatory obligations, the contractor is exposed to the following sanctions: name and shame, fine and negative rating of the label "Eco-energy tertiary".

September 30 was supposed to mark the end of OPERAT declarations... But then, on September 22, 2022, the news broke: "a tolerance for filling in these declarations has been granted until December 31, 2022". For some, this postponement was predictable news, for others it was eagerly awaited, and for others it came as a surprise.
Whatever your situation, we'd like to set the record straight on this latest press release.
Postponing the deadline: why?
According to the press release published on 22/09/2022, more than 150 million m² of commercial buildings have already declared their data on the OPERAT platform. Nevertheless, a postponement has been envisaged to give time to those who have not yet declared their consumption to do so. This postponement offers an additional three months in which to complete the process, which remains mandatory.
This tolerance follows the logic of the "learning year" adopted by the Ministry of Ecological Transition and Territorial Cohesion, as well as the Ministry of Energy Transition.
In addition, when using the OPERAT platform, we can see that some features are not yet accessible. These three months will be an opportunity for all taxpayers to fill in this information, which will be unlocked as time goes by.

What attitude to adopt?
First of all, you have to keep in mind that this declaration is a legal obligation. It is therefore necessary to do so.
The key words are "don't panic". But why?
If you have already made your declarations, the postponement represents a bonus period. If necessary, you will be able to refine your area declarations as well as your choice of the reference year. You will also have to fill in the other subcategories which will be unlocked as you go along on OPERAT.
If you have not completed your declarations, you can take advantage of this postponement to finalize your declarations. Please take the time to fill in the area data completely and take the time to choose your reference year.
If you have not yet started your declarations, we advise you to familiarize yourself with the platform as soon as possible. A certain amount of input data is required to correctly fill in the categories and subcategories of the OPERAT platform. The more familiar you are with the input data, the more efficient you will be in searching and analyzing it.
What action to take?
This postponement is an opportunity for everyone to perfect their choice of the reference year. For this, many calculation strategies are available to you!
Do not hesitate to refine as much as possible your surface cuttings. This zoning may seem superfluous. However, the more precise your surface divisions are, the less you risk being penalized by consumption ratios that are difficult to achieve. Moreover, if you have not done any zoning, it will become mandatory next year. We therefore strongly encourage you to dive into this task if it has not yet been started/completed.
In any case, don't forget to keep up to date with the platform's updates. These updates will unlock new features to be filled in as time goes by.
